Existing law establishes certain prohibitions relating to water pollution in Lake Tahoe and within the Lake Tahoe Watershed. (NRS 445A.170-445A.190) Section 1 of this bill prohibits a person from selling, offering for sale or distributing for sale water in a disposable plastic bottle that has a capacity of not more than 4 liters in any community which abuts the Lake Tahoe Watershed. Section 1 requires the local board of health or health department to enforce this prohibition. Section 1 further requires the local board of health or health department to: (1) for a first violation of section 1 within 1 year, issue a warning; (2) for a second violation within 1 year, impose an administrative fine of not more than $100; (3) for a third violation within 1 year, impose an administrative fine of not more than $200; and (4) for a fourth or subsequent violation within 1 year impose an administrative fine of not more than $500.
